Call to Order/Invocation
The Town Council of the Town of Belhaven met in regular session on Monday, March 5, 2001 at 7:30 P.M. in the Council Chambers at Town Hall. Dr. Charles O. Boyette, Mayor, called the meeting to order with the following Council members present: Walt Allen, Albert Baker, George R. Ebron, Jr., Cynthia M. Heath and James B. Hodges. Tim M. Johnson, Town Manager, Keith B. Mason, Town Attorney and Marie J. Adams, Town Clerk were also present. Mayor Boyette gave the invocation.

Approval of Minutes - February 19, 2001 Public Hearing/Regular Session
Mayor Boyette announced that the minutes of the February 19, 2001 meeting were open for review and adoption. There being no corrections to the minutes, Councilman Hodges made the motion to approve. Councilman Allen seconded the motion which carried unanimously.

Sewer Inflow and Infiltration Grant Application - Resolution
Mayor Boyette stated that the town had applied for a grant to film and smoke test the sewer lines to find where inflow and infiltration of storm sewer was seeping into the sewer lines. Mayor Boyette stated that if funded this grant would be a 80/20 with the total cost being $50,000 of which $10,000 would be paid through town funds. Town Manager Johnson stated this was a competitive grant application and felt the town had a good chance for funding by committing $10,000. Mayor Boyette read the following resolution.

Resolution by the Town of Belhaven /Inflow and Infiltration Study

WHEREAS, The Federal Clean Water Act Amendments of 1987, Federal Safe Drinking Water Act Amendments of 1996, and the North Carolina Clean Water Revolving Loan and Grant Act of 1998 have authorized the making of loans and grants to aid eligible units of government in financing the cost of wastewater treatment works,
wastewater collection systems, and water supply systems and,

WHEREAS, The Town of Belhaven has need for and intends to conduct an I/I Study of its Sewerage Collection System.

WHEREAS, The Town of Belhaven intends to request state grant assistance for the project,

NOW, THEREFORE BE IT RESOLVED, BY THE BELHAVEN TOWN COUNCIL OF THE TOWN OF BELHAVEN:

That the Town of Belhaven will provide 20% of overall costs of the project, if approved for a State grant.

That the Town of Belhaven will provide for efficient operation and maintenance of the project on completion.

That Charles O. Boyette, Mayor, and successors so titled, is hereby authorized to execute and file an application on behalf of the Town of Belhaven with the State of North Carolina for a grant to aid in removal of extraneous water from its sewage collection system.

That Charles O. Boyette, Mayor, and successors so titled, is hereby authorized and directed to furnish such information as the appropriate State agency may request in connection with such application or the project: to make the assurances as contained above; and to execute such other documents as may be required in connection with the application.

That the Town of Belhaven has substantially complied or will substantially comply with all Federal, State, and local laws, rules, regulations and ordinances applicable to the project and to Federal and State grants and loans pertaining thereto.

Adopted this the 5th day of March, 2001.

Councilman Allen made the motion adopting the resolution as read. Councilman Ebron seconded the motion which carried unanimously.

Water Plant Authorization and Documentation Resolution
Mayor Boyette stated that they proceed with the water plant, the following documents would need to be adopted through the following resolution, which would allow the Mayor to execute all forms necessary to obtain a loan from USDA Rural Utilities Service. Mayor Boyette stated that the total cost of the Water Treatment Plant project was $3,085,000. Mayor Boyette read the following resolution.

TOWN OF BELHAVEN Water Plant Authorization and Documentation Resolution

THAT the Town of Belhaven accepts the Amendment dated March 5, 2001 to the Letter of Conditions dated November 13, 1996 and the RUS Bulletin 1780-27, "Loan Resolution (Public Bodies)":

THAT the Town of Belhaven Town Council approve the revised budget as shown on Form FMHA 442-7, "Operating Budget,":

THAT the Mayor and Town Clerk be authorized to execute all forms necessary to obtain a loan from USDA Rural Utilities Service, including but not limited to the following forms:

RUS Bulletin 1 780-27     "Loan Resolution"
Form RD 1942-46;     "Letter of Intent to Meet Conditions"
Form FMHA 442-7     "Operating Budget" (revised)
Form 400-4      "Assurance Agreement"
Form 400-1     "Equal Opportunity Agreement"

Form 1910-11     "Applicant Certification Federal Collection Policies"

This resolution is to become part of the official minutes of the Town Council meeting held on March 5, 2001.

MOTION MADE BY: Councilman James B. Hodges

SECONDED BY: Councilman/ Mayor Pro-Tem George R. Ebron, Jr.

TO ADOPT THE RESOLUTION: MOTION PASSED 5 to 0.

Councilman Hodges made the motion approving the resolution authorizing the Mayor to execute all necessary documents associated with the resolution. Councilman Ebron seconded the motion which carried unanimously.



Town Manager's Report
Town Manager Johnson reported briefly on the following: Main Sewer Line Break - beside Town Hall on Allen Street - cost to repair or replace may be estimated from $8,000 - $20,000;

Prepared should winter storm hit the NC Coast;

Bucket Truck failed testing, therefore without bucket truck until repaired - looking for standby truck to rent temporarily;

Announced that $835,000 and $100,000 had been secured in grants for the construction of the water plant with the balance being a low interest loan for $2,150,000;

Mayor Boyette asked if the citizens who expressed questions and concerns on the Hazard Mitigation program, at the last meeting had contacted the Manager;

Town Manager Johnson stated that the citizens had contacted him and the citizens had received misinformation and were satisfied after their meeting.

Public Comments
Mayor Boyette asked for any comments from the public.

Mayor Boyette recognized Mrs. Elaine Hudnell, resident of Pungo Street, who approached the Town Manager with a hand written bill to the Town for supposedly being overcharged for copies of public records. Mrs. Hudnell explained that she was charged for some copies and .50 per copy for other copies of public records which is not the same as someone requesting a regular copy. Town Manager Johnson stated that copies were .25 and he would not make any reimbursements unless the Council directed him to. After some discussion, Council consensus was to have Town Attorney Mason check on permitted charges for public records.

Adjournment
There being no further business, Councilman Allen made the motion to adjourn. Councilman Hodges seconded the motion which carried unanimously. The meeting adjourned at 7:50 P.M.
